Jackson Lewis’ Corporate Counsel Conference addresses the significant legislative and regulatory developments in workplace law and provides opportunities for discussion and collaboration about these topics.

Our upcoming program will feature a robust discussion about the recent increase in sexual harassment claims in Silicon Valley, Hollywood and beyond. Joining us to discuss this issue is Anita Hill, who forever changed how our country views sexual harassment in the workplace. 

We will also address the recent trends in workplace law, and what to expect from the Supreme Court and administrative agencies in the year ahead. To help provide context on these issues, we will be joined by Robert Costa, moderator of "Washington Week" and national political reporter for The Washington Post.

Keynote Speakers

Anita Hill is a University Professor of Social Policy, Law and Women's Studies at Brandeis University. Since being thrust into the national spotlight in 1991 during her testimony at the Clarence Thomas Senate confirmation hearings, Ms. Hill has been a central figures in creating awareness around sexual harassment in the workplace and beyond. Practicing lawyer, educator, activist and author, Ms. Hill will discuss her integral role bringing this important issue to light and advocating for changes in the law that continue to resonate today.

Robert Costa is a journalist and national political reporter for The Washington Post, a political analyst for NBC News and MSNBC, and the moderator of "Washington Week". Mr. Costa will offer a comprehensive overview of the current political landscape and the latest issues facing the country in light of the Trump Administration and its effect on the workplace.

Who Will Lead So Others Can Follow? Anita Hill’s Very Public Stance Against Injustice Aimed at Those Beholden to Uphold It

In October 1991, when Clarence Thomas was seeking a seat on the United States Supreme Court, one immovable force stood between him and confirmation to the nation’s highest court. 35-year-old law professor Anita Hill sat in front of an all-male, all-white U.S. Senate Judiciary committee for three days to testify about the sexual harassment she was subjected to while working for Clarence Thomas. The country was riveted by the salacious scandal unfolding before their eyes as millions of Americans tuned in to the live hearings. Thomas was confirmed, but not before Ms. Hill’s testimony brought the issue of sexual harassment in the workplace to widespread public attention.

The Speak Out Evolution from Ms. Magazine to #MeToo: What Employers Should Do Now

Neither the law prohibiting sexual harassment nor the conduct that constitutes sexual harassment has changed. What has changed is the sheer number of those who speak out and the volume with which they do so, amplified by social media. While the focus to date has been on celebrities, public figures and business leaders, next up in the “speak out evolution” is likely a movement from #MeToo to #IHeard, #ISaw and #IWitnessed and an uptick in claims against employers and individuals outside the public eye. It is this next phase of the “speak out evolution” – which has already begun – for which employers must be prepared. A panel of outside and in-house legal, human resources and public relations professionals will discuss what employers should do—and what they should do differently now—in terms of harassment prevention, training and remediation.

Class and Collective Actions: Navigating Through the Storm
Join us for a cutting-edge analysis of the Supreme Court’s most recent class action decisions and emerging trends. We will offer practical advice on prevention measures, as well as what to do if your company is hit with a potentially crippling lawsuit. We will also discuss the status of the controversial Fairness in Class Action Litigation Act and the impact of potential future amendments to Rule 23.

When the In-House Lawyer is the “Whistleblower” 
Defending “whistleblower” retaliation claims brought by in-house counsel brings many unique hurdles. This session will cover ethical—and other limitations—on in-house counsel’s ability to acquire, produce and/or use privileged and confidential information; application of the Rules of Professional Conduct and other attorney ethical obligations; legal issues regarding protected activity; and potential discovery-related issues. Familiar Problems, New Solutions: An Examination of the Next Generation of Leave Challenges and Opportunities
As federal leave management legislation stalls, multi-state employers are increasingly challenged by a “new federalism” in which states and localities are enacting much broader leave and accommodation protections to fill the gaps. Meanwhile, federal courts are increasingly divided on the scope of ADA leave obligations. This session will cover all recent developments in fiduciary litigation under the Employee Retirement Income Security Act (ERISA) and best practices fiduciaries can employ to minimize risk. The following key topics will be discussed: plan governance, delegations of authority and the fiduciary decision making process. We will also address the current focus being placed by the DOL and plaintiffs on the application of fiduciary responsibility under ERISA to issues of payments to missing participants, 401(k) investment offerings and the proper handling of claims and appeals.

The Troubling Wave of Sexual Violence on College Campuses and U.S. Secretary of Education Betsy DeVos’ Plan to Address It
Recent statistics suggest a sharp increase in reports of sexual violence and Title IX claims on university campuses. The good news is that the rise in reports likely has a direct correlation to today’s generation of college students becoming more informed because of public information campaigns and changing cultural norms. The bad news is that more and better reporting leads to increased investigations and disciplinary hearings, disciplinary suspensions and expulsions, and lawsuits filed against colleges and universities by affected students. We will explore what’s really happening on college campuses, and review the latest legal developments and political actions in response.

Trends in International Workplace Law: Nationalism, Data Protection and More
We are in the midst of transformational change in employment law in many countries, as the current U.S. debate between globalists and nationalists is mirrored throughout the globe, and governments continue to combat slow growth and wage stagnation. Some of these changes mitigate the traditional ex-U.S. restrictions on employer flexibility, while others add entirely new complexities. In this workshop, we will use hypothetical scenarios to review some of the major developments of the past year, including Brexit and major labor/employment law reforms in France, Brazil, Puerto Rico and other countries in Latin America and Asia.
