FCRA "Summary of Rights" Has Been Updated Under FACT Act Requirements

The Fair and Accurate Credit Transactions Act of 2003, or FACT Act, required the Federal Trade Commission to issue and update certain documents. Most notably for employers conducting background checks using a third party consumer reporting agency, the FTC's summary of the rights of consumers under the Fair Credit Reporting Act has been updated. This summary is required to accompany a pre-adverse action notice, along with the consumer report the employer is relying upon in possibly making a pre-adverse action notice. The updated summary of rights also directs how Spanish-speaking individuals can obtain further information. Other new FTC documents include the furnisher and user notices that explain to employers their duties under the FCRA. A copy of the FTC's updated summary of rights, for use as of January 31, 2005, can be downloaded from the Federal Trade Commission website.
