The law regarding sexual harassment in the workplace has not substantially changed in more than 30 years. Nonetheless, claims of sexual harassment in the workplace are grabbing headlines like never before. While the focus to date has been on celebrities, public figures and business leaders, we believe the prevalence and notoriety of these stories will lead to an increase in internal complaints and/or claims alleging similar misconduct against individuals and entities that are outside the public eye. As a result, now is an important time for employers to (1) Review their sexual harassment and other EEO policies; (2) Redistribute such policies to all employees to remind them of the employer’s expectations and complaint procedure; and (3) Conduct training for executives, managers and supervisors with respect to these policies. Employers taking these proactive measures may prevent unlawful harassment in the workplace, thus minimizing the substantial risks and liabilities associated with such conduct.
