Federal anti-discrimination laws do not list sexual orientation or transgender status as protected categories. However, the Supreme Court held in 1989 that treating someone differently due to failure to conform to gender stereotypes is a form of gender discrimination.  In 2015, the EEOC applied these principles to rule that employment discrimination against employees because they are gay or transgender is necessarily discrimination because of sex.
