As you may have read in the news recently, large private universities are being targeted with ERISA class action lawsuits claiming, among other things, that their retirement plans are charging participants excessive fees and offering too many investment alternatives.   These lawsuits are being brought under ERISA, the federal law which governs group employee benefit plans of private employers. While the current crop of actions have not targeted public universities with governmental plans exempt from ERISA, it is important to note that the same fiduciary principles often apply under state trust law so all Plan Sponsors should be monitoring these developments.
