This presentation will provide an update regarding proposed changes to existing regulations and law.  This presentation will also discuss the areas in which federal agencies are focusing their enforcement efforts.  Topics include:

  • The EEOC recently released new guidance on retaliation, which now accounts for over 45% of all claims filed with the EEOC. 
  • The EEOC’s proposed changes to the EEO-1 reporting requirements (applicable to employers with 100 or more employees, as well as federal contractors), which would require submission of extensive compensation data to be used as a tool in ferreting out systemic wage discrimination. 
  • The DOL’s proposed changes to the overtime exemptions for white collar workers.  
  • Recent efforts by the EEOC to expand protection against sexual orientation and gender identity discrimination, and OSHA’s stance on bathroom access. 
  • The NLRB’s expansive interpretation of “protected concerted activity” as applied to work rules, social media, and email communications, just to name a few.  This is a concept that impacts all employers, whether union or non-union
