OSHA ETS Federal and State Plan Map for Private Employers

Will State Plan jurisdictions adopt the OSHA ETS on Vaccination and Testing? This map identifies the 22 states and territories with State Plans covering private employers.  State Plans are OSHA-approved workplace safety and health programs operated by the state or territory. For employers in State Plan jurisdictions, it is critical to know if their state adopts the federal ETS or adopts a different standard. We are monitoring the State Plan jurisdictions and will update this map as jurisdictions take action. The map will be updated regularly but for more detail, please check with counsel for detailed information and advice.*

*Some states and localities have passed laws or taken executive action that conflict with the OSHA ETS on Vaccination and Testing. The map only reflects official actions that have been taken with regard to adoption (or lack of adoption) of the ETS by each State Plan. This map does not address pending litigation.  For information about the OSHA ETS on Vaccination and Testing, including the current status of litigation challenging the ETS, visit our OSHA Law Blog.
