Jason K. Roberts


Jason K. Roberts is of counsel in the Philadelphia, Pennsylvania office of Jackson Lewis P.C. He has over a decade of experience as an employment lawyer with a practice that focuses on representing employers in workplace law matters on issues involving employee discipline and termination, protection of confidential information, restrictive covenants, discrimination, and harassment. 

Jason has experience with employment matters in state and federal courts around the country and has handled matters in private arbitration in the Financial Industry Regulatory Authority. He has conducted employment investigations involving issues such as sexual harassment and employee misconduct, drafted and advised clients on employment policies and procedures as well as performed extensive legal research in all major areas of employment law, including the Americans with Disabilities Act, the Family and Medical Leave Act, the Fair Labor Standards Act, the Employee Retirement Income Security Act, the Age Discrimination in Employment Act, and Title VII. Jason has also advised employers and employees on the enforceability of restrictive covenants. While in law school, Jason interned with the Civil Rights Division of the United States Department of Justice in Washington, D.C. providing him with invaluable insight into conducting workplace investigations.  

Some of Jason’s recent litigation success includes:

  • Obtaining summary judgment in favor of a hospital on FMLA interference and retaliation claims in federal court. 
  • Obtaining dismissal in favor of a hospital on race and national origin discrimination, retaliation, hostile work environment, defamation, and contract claims in federal court. Decision affirmed on appeal.
  • Obtained jury verdict for the defense in former employee’s Title VII and FMLA trial in federal court. Jury verdict affirmed on appeal. 
  • Obtained arbitration award in favor of brokerage firm against former employee’s breach of contract and unjust enrichment claims relating to incentive compensation plans.  
  • Obtained arbitration award in favor of brokerage firm against former employee’s $2.5 million defamation claim. 
  • Obtained injunctive relief and Order of Attachment in Aid of Arbitration to recover funds fraudulently obtained by former employee in connection with recruitment to client. 
  • Obtained dismissal in favor of brokerage firm on race and national origin discrimination claims in federal court.
