Reshaping the Judiciary

The number of judicial appointments under the Trump administration has shifted the ideological balance of the bench, ushering in a cadre of judges with a stronger commitment to conservative jurisprudence than their predecessors.

Reshaping the Judiciary

Overview

Among other significant appointments, President Trump appointed two members of the Supreme Court of the United States during his presidency – possibly three, should Amy Coney Barrett get confirmed. If a new administration takes the helm in 2021, we can anticipate appointments of judges who may be less textualist and more open to interpretation.  How will these fundamental differences on the bench affect future decisions? The selection of judges and the decisions those judges make could effectuate significant changes to workplace law for years to come. Our attorneys are focused on the candidates and their positions in order to help clients anticipate and prepare for the outcome and its implication for their business.
