ICE to Issue Form I-9 Audit Notices to Employers in Denver

Jackson Lewis has learned that the United States Immigration and Customs Enforcement (“ICE”) will be issuing notices of inspection to review the hiring records of some employers based in Denver on February 14, 2011.   The employers will have three days to produce I-9 forms or fines will be assessed.  ICE will inspect and review hiring records to determine whether they comply with employment eligibility verification laws and regulations.

Worksite Enforcement Initiative

ICE implemented a nationwide worksite enforcement initiative in 2009 to focus on auditing and investigating employers to “hold employers accountable for their hiring practices.”  In 2010, ICE filed a record number of criminal complaints and notices of inspection that resulted in the highest fines in history.

Prepare for an Audit

Employers can best prepare by taking preventive measures that include:

  • conducting in-house audits of I-9s,
  • correcting form errors,
  • formalizing or updating employment eligibility verification practices and procedures,
  • establishing ongoing I-9 training programs, and
  • analyzing subcontractor and temporary staffing relationships.
