INS Expands List of Nationalities Required to Register

The Immigration and Naturalization Service (INS) has expanded the list of nationalities required to appear for special registration. The INS notice, which is to be published in the Federal Register on January 16, 2003, requires that individuals meeting the following criteria appear before an immigration officer between February 24, 2003 and March 28, 2003:

  1. A male who was born on or before February 24, 1987;
  2. Is a national or citizen of Bangladesh, Egypt, Indonesia, Jordan and Kuwait, who was inspected by the Immigration and Naturalization Service and was last admitted to the United States as a nonimmigrant on or before September 30, 2002; AND
  3. Will remain in the United States after March 28, 2003.

This notice applies to dual citizens, i.e. any alien who is a national or citizen of one of the designated countries, notwithstanding the fact that they are also nationals or citizens of another country. This notice expands on the November 6, 2002, the November 25, 2002, and the December 17, 2002 notices in which INS announced that certain nationals or citizens from the following countries would be subject to special registration requirements: Iran, Iraq, Libya, Sudan, Syria, Afghanistan, Algeria, Bahrain, Eritrea, Lebanon, Morocco, North Korea, Oman, Qatar, Somalia, Tunisia, United Arab Emirates, Yemen, Pakistan and Saudi Arabia.

As before, it is important that your employees be aware of the new registration requirements, since willful failure to comply could result in deportation.
