Colorado’s new Equal Pay for Equal Work Act will bring significant new obligations for Colorado employers. In an effort to help close the “pay gap,” companies will soon be required to include pay rate and benefits information in job postings, provide employees with notice of promotional opportunities, and prohibit requests for applicants’ prior compensation information. Moreover, the Act creates a new private right of action that goes well beyond federal law, making it much easier for employees to bring successful claims of pay discrimination.

While the Equal Pay for Equal Work Act does not go into effect until January 1, 2021, employers need to start planning now for all the new requirements.
