Following the Trump administration’s creation of a Religious Liberty Commission and its executive order on “Eradicating Anti Christian Bias,” the EEOC has emphasized the enforcement of religious accommodation obligations in the workplace. Employers must be especially mindful of their duty to evaluate and respond to requests for religious accommodation that may conflict with workplace policies. In Groff v. DeJoy (2023), the Supreme Court clarified the framework for assessing when an employer may deny a religious accommodation under Title VII based on undue hardship. We will discuss the current legal standards, the types of accommodations that may be required and practical strategies for managing conflicts between religious practices and other employees’ rights to a harassment free workplace.
