My Kim Ong

Kim Ong is an associate in the San Francisco, California, office of Jackson Lewis P.C. Her practice focuses on ERISA litigation, employee benefits, and employment law. She represents plan sponsors, multiemployer plan trustees, fiduciaries, employers, and other stakeholders in complex litigation, regulatory proceedings, and counseling matters.

Kim has experience handling a broad range of disputes arising under the Employee Retirement Income Security Act of 1974 (ERISA), including fiduciary breach class actions, benefits litigation, and statutory enforcement actions involving multiemployer plans. Her work includes defending fiduciary breach claims related to retirement plan investments, including excessive fee and stable value fund litigation; actuarial equivalence challenges to pension benefit calculations; claims under the Mental Health Parity and Addiction Equity Act; and disputes involving delinquent contributions and withdrawal liability. She assists clients through all stages of litigation, from pre-suit strategy and risk assessment through trial and appeal.

Kim also represents employers in a broad range of workplace law matters. She represents employers in employment litigation and administrative proceedings involving claims of discrimination, harassment, retaliation, wrongful termination, wage and hour violations, and other employment-related disputes. In addition, she provides practical, preventive counseling on day-to-day workplace issues, including employee relations, workplace investigations, personnel decisions, leave and accommodation matters, policy development, and compliance with federal, state, and local employment laws. Drawing on her litigation experience, Kim helps employers proactively manage risk and navigate complex workplace challenges. 

Beyond her litigation practice, Kim advises employers, plan sponsors, and fiduciaries on employee benefit plan design and administration, fiduciary governance, and the management of benefit claims and appeals. 

Kim earned her J.D. from the University of San Francisco School of Law, where she was named Moot Court Advocate of the Year, served as Technical Editor of the University of San Francisco Law Review, and was Vice President of the Asian Pacific American Law Student Association.
