
Marco A. Garcia
Marco A. Garcia is an Associate in the San Diego, California, office of Jackson Lewis P.C. His practice focuses on representing employers in workplace law matters, including preventive advice and counseling.
Marco is a fierce litigator, trusted advisor, and a leader. Marco litigates in federal, state court and arbitration. Marco has been recognized by Southern California Super Lawyers, as a “Rising Star” (2025) and recognized by San Diego Metro Magazine as San Diego’s Top 25 Attorneys of 2025.
As a litigator, Marco represents a wide range of employers in matters pertaining to wrongful termination, discrimination, retaliation, harassment, failure to accommodate, restrictive covenants, noncompetition agreements, PAGA, wage and hour claims, class actions, and employment contract disputes. Through attention to detail and a client centric approach, Marco has achieved numerous cost-effective, favorable results for his clients.
As an advisor, Marco has distinguished himself for his ability to convey complex issues into practical matters. Through his innovative and straight forward counsel, Marco has fostered positive relationships with a wide range of clients including Fortune 500 companies, mom-and-pop shops, and non-profits. Marco counsel’s employers in a wide range of issues including employment practice risks and adopting best practices, employment agreements, performance management, leaves of absence, disability accommodations, reduction in force (WARN) and termination, internal investigations, dispute resolution, employee training, and wage and hour law.
As a leader, Marco has distinguished himself for his emotional intelligence and wealth of leadership experience. In the community, Marco serves as the President of San Diego La Raza Lawyers Association, Graduate and New Attorney Representative for Latinas in the Law, and was appointed to the San Diego County Bar Association Leadership Outreach Committee. Marco also serves on the board of his local Home Owners Association. At Jackson Lewis, Marco is part of the recruitment team that interviews prospective candidates and provides recommendations to the Office Managing Principal.
Prior to law school, Marco worked as a Human Resource Information Systems Supervisor for the San Diego District Attorney’s Office, where he managed departmental personnel staffing needs, participated in recruitment and selection programs, formulated and implemented new resources/personnel policies, delivered oral presentations, oversaw the payroll department and much more.
While in law school, Marco was a recipient of multiple awards and distinctions, including a Distinguished Advocate award (1 of 2), for his excellence in Alternate Dispute Resolution; was 1 of 26 law students in the State of California to be selected for a highly competitive California ChangeLawyers Scholarship; earned multiple San Diego La Raza Lawyers Association scholarships, including a Bar stipend; and was selected as a Diversity Fellow by the San Diego County Bar Association.
During his free time Marco enjoys spending time with family and friends. Marco routinely exercises and enjoys long strenuous hikes including Mount Whitney and Yosemite’s Half Dome.
