Emerging Issues, Proactive Strategies: Disability and Leave Management
Speakers: Katrin Schatz and Kristin Bauer
Protections for ill, injured, and pregnant workers continue to expand at the state and federal level. Employers are still struggling to adapt to a post-pandemic workplace and changing economic realities. Add to that new compliance obligations and rapid technological advances, and you have the perfect storm of compliance challenges for disability, leave and health management. In this interactive session, we’ll review emerging trends and discuss practical strategies for employers of all sizes, whether single- or multi-state, to navigate an increasingly complex legal framework. Topics covered include ADA and FMLA case law updates and enforcement priorities, ongoing challenges in managing remote work, new protections for pregnant workers (including the Pregnant Workers’ Fairness Act of 2022), disability-related risks in recruitment and hiring (including the use of AI), wellness initiatives, the expansion of paid leave, the continued proliferation of state-law protections for marijuana users, the intersection of disability and discrimination against older workers, and more. We’ll then discuss how employers can leverage this information to prioritize compliance initiatives to align with applicable agency guidance and enforcement priorities and implement sensible and practical strategies for managing legal exposure in a rapidly changing work environment.

Knock Knock! The Government is Here
Speaker: Michael DePonte
From the EEOC, the DOL to the NLRB, every government agency has an initiative and an agenda. Understanding the latest changes, new rules, and the Courts’ interpretations of these, is critical to remaining in compliance before a visit from the government. In this session we’ll discuss the latest updates from the federal and state governments and how to address compliance issues with your current policies, how to plan for government audits, and develop workplace strategies moving forward.
