In the final days of its 2019 session, the New York State Legislature enacted a flurry of legislation that will have significant and extensive effects on New York employers. These effects include greater potential liability for harassment and discrimination claims.

  • Removal of the “severe or pervasive” standard for determining whether an employer has subjected an employee to harassment
  • Elimination of the “Faragher/Ellerth” defense 
  • Expansion of the non-disclosure agreement prohibition to apply to all discrimination and harassment claims unless it is the plaintiff’s preference to enter into a non-disclosure agreement
  • Increase to the sexual harassment policy requirements and damages available to prevailing claimants
