Flying under the radar, a new Illinois Human Rights Act law passed on August 2, 2021, makes it a civil rights violation to discriminate against employees and job applicants based on work authorization status. Although this may seem innocuous, the state law goes beyond the federal law requirements and further restricts whether an employer can base a hiring decision on a work authorization status that will expire or may not be able to be renewed. Hiring practices need to be reviewed to ensure that all application forms and hiring guidelines fit with this new law.
