COVID-19 Testing 
With the pandemic continuing to impact the world, we must expect that engaging in employee testing will remain a critical and legally complex issue. What are the different approaches an employer should focus on to lawfully test employees?

Vaccinations  
Mandatory and non-mandatory policies bring different issues to the forefront as employers must wrestle with creating safe work environments that assure there will be no discrimination against non-vaccinated employees.

American Rescue Plan Act

Identifying those under the influence, what actions to take and testing limitations are just a few of the many issues confronting New York employers with the now lawful use of marijuana.

Diversity & Inclusion 
Employers must move beyond policy statements and understand what steps they can or should take to ensure these terms become embedded in the fabric of their institutions.

“Protected-Concerted Activity” 
The NLRB has indicated a re-commitment to view social justice efforts and the expression of a myriad of employee issues as falling under their jurisdiction. Employers must understand how this may substantially imperil imposing discipline on historically improper workplace conduct.

Immigration
A new administration often brings a different approach to immigration opportunities and processes, which will be the case in the Biden Administration as well. Employers must adapt quickly.

Wage & Hour 
Tracking and limiting work from home raises numerous practical and legal issues with great impact on hours worked and paid. New York employers need to be familiar with lawful approaches and some DOL rules that are company friendly to limit their exposure in this arena.
