Brian A. Aslin is of counsel in the Austin, Texas, office of Jackson Lewis P.C. He is a labor and employment attorney with a record of success as lead counsel before juries, judges, and appellate courts.

Brian has represented Fortune 50 corporations and small businesses alike, providing responsive, practical counsel to employers with a focus on the technology and healthcare sectors. Brian’s substantial courtroom experience distinguishes him from his peers as a credible and persuasive advocate who can quarterback matters with confidence.

A skilled litigator, Brian represents employers in:

  • Discrimination, retaliation, and harassment cases that arise under Title VII, the Americans with Disabilities Act (ADA), the Family Medical Leave Act (FMLA), the Age Discrimination in Employment Act (ADEA), and the Texas Commission on Human Rights Act (Chapter 21 of the Texas Labor Code);
  • Unfair competition and trade secret disputes that involve restrictive covenants such as non-compete and non-solicitation agreements;
  • Charges of Discrimination filed with administrative agencies such as the Equal Employment Opportunity Commission (EEOC), Texas Workforce Commission (TWC), and the City of Austin’s Office of Civil Rights; and
  • Traditional labor matters including union organizing campaigns, representation case hearings, collective bargaining, arbitrations, and unfair labor practice charges before the National Labor Relations Board (NLRB).

In addition to an active litigation practice, Brian regularly provides employers with proactive advice and counsel on all aspects of the employment relationship, including multistate compliance for employers with remote workers or physical locations in multiple states, employee handbook and policy reviews and guidance on high-risk employee separations.

Before joining Jackson Lewis, Brian practiced law in the Austin office of an international labor and employment law firm. Previously, Brian served as an Assistant Attorney General for the State of Texas where his practice focused on high-impact employment litigation. At the Office of the Attorney General, he obtained successful results for clients at jury trial, appellate oral argument, and in hearings on emergency temporary restraining orders, temporary injunctions, and dispositive motions—all as attorney-in-charge. A former prosecutor, Brian began his career as an Assistant District Attorney where he achieved an undefeated first-chair jury trial record and served as a Court Chief.

Brian earned his Juris Doctor from Baylor University School of Law, where he was a member of the Order of the Barristers, and a Bachelor of Fine Arts in Theatre Performance with a minor in Religion from Baylor University.

A community-driven leader, Brian serves on the board of directors for several non-profit organizations and on the Executive Committee of the Baylor Law Alumni Association. In 2023, Brian was elected a Fellow of the Texas Bar Foundation. Brian is a frequent educator and speaker on labor and employment law issues.
