Jerry S. Hoffman is a Principal in the Albany, New York, office of Jackson Lewis P.C. He assists clients in meeting the challenges of an ever-changing health care environment by finding innovative ways to ease their regulatory burdens and providing creative, cost-effective strategies to complete their transactions. He is particularly adept at helping clients implement new organizational structures and delivery modalities and obtain funding for innovative projects. Mr. Hoffman also works closely with clients to secure government authorization for their projects.

Mr. Hoffman brings many years of practical experience to his work. His private practice background coupled with his long tenure working in government relations allows Mr. Hoffman to provide clients with straightforward guidance to meet their regulatory requirements and business goals. Clients often call on Mr. Hoffman to facilitate projects that bridge the corporate and government worlds.

Mr. Hoffman joins Jackson Lewis after almost 20 years of private practice in the health law field. Prior to that, Mr. Hoffman served as vice president of government relations at the Healthcare Association of New York State. He also served as legislative counsel for the Medical Society of the State of New York. Mr. Hoffman began his career as a corporate and securities attorney in New York City.

Health Care

Mr. Hoffman’s clients include hospitals, nursing homes, adult care facilities, managed long term care plans, assisted living programs, home care agencies (both certified and licensed), behavioral health providers and physicians and physician groups.

As general counsel to many health care providers, Mr. Hoffman has helped clients navigate the complex and often inconsistent worlds of health care delivery and reform. Mr. Hoffman works closely with clients to improve their operations and governance and accomplish their strategic goals. Mr. Hoffman also assists clients in managing complex government investigations and in navigating the intricacies of fraud and abuse laws and regulations as well as the complexities of the HIPAA and HITECH regulatory framework.

Mr. Hoffman has counseled clients in the formation and development of new facilities and delivery entities. He is experienced at handling a wide array of health care transactions, including contract structuring and negotiation, asset sale and purchase agreements, and physician-hospital ventures, as well as meeting the regulatory requirements under both the fraud and abuse and tax-exempt organization rules. Mr. Hoffman also counsels hospitals and other health care clients on day-to-day issues such as physician recruitment, contracting and discipline, governance and administrative matters, vendor contracting and other operational matters.

On the regulatory front, Mr. Hoffman represents health care providers in their interactions with government agencies both in New York State and nationally, including, but not limited to, the New York State Department of Health, the New York State Attorney General’s Office, the New York State Division of the Budget, the New York State Department of Education, the New York State Department of Financial Services, the New York State Office of Mental Health, the New York State Comptroller’s Office, and the Centers for Medicare and Medicaid Services.
